Terms of Service

1. Service

NexGuard is a product of Adstore LLC ("Company", "we"). NexGuard provides client software and managed private network infrastructure ("Service") to organizations and teams ("Customer", "you"). By creating an account, you agree to these terms on behalf of your organization.

2. Infrastructure Provider

NexGuard is an infrastructure provider, not a network content moderator. We provide dedicated servers and encrypted tunnels. We do not monitor, inspect, filter, or log network traffic passing through customer servers. The Customer is the sole operator of their network infrastructure deployed through NexGuard.

3. Customer Responsibility

By using NexGuard, you acknowledge and agree that:

• You are solely responsible for all network traffic routed through your dedicated servers
• You are responsible for managing device access and user permissions
• You will comply with all applicable laws in your jurisdiction
• You will not use the Service to circumvent legal restrictions in your country
• You are responsible for maintaining your own traffic logs if required by your local regulations
• You will ensure all users authorized by you comply with these terms

4. Accounts

Registration requires a valid organization name, email address, and acceptance of these terms. You are responsible for account security, device token confidentiality, and all activity under your account. Paid plans require a valid payment method processed through our Merchant of Record, Paddle.com Market Limited. All subscription payments, invoicing, and refunds are handled by Paddle in accordance with their terms of service.

5. Pricing and Refunds

NexGuard offers Cloud-Managed plans ($9-$59/server/month, 15-250 devices) and Self-Hosted plans (Free with 5 devices, or $9-$29/server/month with 50-250 devices). Enterprise plans with custom device limits are available upon request — contact hello@nexguard.sh for a custom quote. All paid plans include a 14-day money-back guarantee. 6. Acceptable Use

You may not use the Service for:

• Any illegal activities under applicable law
• Spam, DDoS attacks, malware distribution
• Intellectual property infringement
• Unauthorized access to other systems or networks
• Reselling the Service without written authorization
• Activities that violate the rights of third parties

Violations may result in immediate account termination without refund.

7. Data Retention

In compliance with EU Digital Privacy Enhancement Directive (DPED), we retain connection metadata (device count, connection timestamps, server locations) for 90 days. We do not retain traffic content, browsing history, or source IP addresses. Billing records are retained for 7 years per tax regulations.

8. Server Resources

Managed servers are dedicated to your organization exclusively. Device limits depend on the server plan selected. Free self-hosted plan is limited to 5 devices per server.

9. Termination

Cancel anytime. Cloud servers are deleted within 24 hours of cancellation. Self-hosted server data remains on your infrastructure.

10. Liability

Service provided "as is" without warranty. NexGuard is not liable for any traffic routed through customer servers. Maximum liability limited to fees paid in the last 12 months. NexGuard shall not be liable for any indirect, incidental, or consequential damages.

11. Governing Law

These terms are governed by the laws of the Republic of Uzbekistan. For EU customers, mandatory consumer protection laws of your country of residence apply. Disputes shall be resolved in the courts of Tashkent, Uzbekistan, unless EU mandatory jurisdiction rules apply.
